It sounds as if you have no hope of recovering any judgment
you win. If he has no money, winning a judgment means
nothing.
If he was convicted of assaulting you, you may use the
criminal conviction as evidence of fault. He may not even
come to court to contest your suit so you will get a default
judgment. However, again, you will likely win the judgment
but recover nothing. What do you hope to gain?
