Post: QME Depo/Cross-X

Posted by wc on 4/20/11
I want to get more info on what governs QME depos. I understand that under 35.5 of the regs, the QME is basically given a 120 day window to participate in a depo. If the QME should refuse participation, what kind of costs are recoverable? Can the QME be sanctioned? Can the carrier be reimbursed for the cost of the med eval?, etc. Does anyone know of any case law/statutes that would support this, 5811, 5710, etc., dont seem to really apply as the QME is not a party.
