How hard is it to get back pay? See I made a lot of money at my job. My injurie ended my carrear. They will have to pay a wage differential to me because they cant train me for a job making that much money. So they tried to starve me by cutting off my ttd. My attorney took them to court. It took about 8 weeks. On this monday my attorney went in front of the arbitrator to argue for my continued pay and back pay. Workmens comp attorney didn't show and called my attorney and said they raise the white flag that they will pay my back pay and send me to voc.rehab. If your really hurt and they owe you money your attorney should file a 19b petition to get an early hearing date in front of the arbitrator. If workers comp owes you money and wont pay they can be held in violation of the law. If the arbitrtor holds them in violation then you get the money for that violation which can be thousands of dollars. 9 times out of 10 workers comp will push it to the point right before they are about to get a violation the they will give in. They do this to try and starve you into a low settlement. This is done because of the adjusters. Workmens comp. adjusters are scum bag people. They purposly check your credit reports to see if you are struggling and stop your pay to save the ins. company money. What kind of individual would stop income to a disabled person. A workers comp adjuster would because they are scum. I would love to see them get hurt and have someone do that to them. If you stick it out they will pay but you have to have an aggressive attorney. Good luck.
