Dear Joe
Is this workman comp or is this a car injury and you are
sueing the car insurance company? Almost sounds like both.
I think you could do the workman comp thing your self but you
would need the rules for your state from the workman comp
board....in Hawaii my husband got offered $40,152 for 16%
disability - a complete wash as they call it for all future
settlements....in your case it is different as I believe all
you would be selling is future medical.....you perhaps will
need an attorney as it is related to a car right? I think
arthritis is something they don't pay much for....a hip
replacement might cost $100,000....I am unsure....
Anyway, you need to heal yourself before you try to settle
that is my idea. P.S. don't kid yourself these surgeons
actually do know what 16% equals and on and on....the book for
Hawaii law says $1,800 to $1,900 per point.....Other things
play into it like did they skrew with you and not give you
treatment etc.....There is only so much they can give
you....if you don't sell your future medical you may get no
money but just the future medical.....
look into that - each state has their own rules. We lived in
Hawaii and they are terrible - and my husband was really
expecting $6,000 and he got offered $40,152 and he played real
mean to them.....so you see you never know....it took us 20
months to get a settlement offer.
