Post: Workers comp, knee injury, 3rd party lawsuit

    Posted by Kimono_skunk on 4/21/06

    Hellos all,
I was wondering about my right knee I had hurt twice in the
    same week.
I had notified my boss when the first accident happened, a
fall off a semi unloading ramp, from a 350 pound handcart
loaded with steaks. And the second when later in week, a 35
pound box was tossed and fell on the same knee, injuring it
    again.

Both times the Work doc said I MUST go back on full duty,
even tho I was sore, and again after the 2nd injury. Work
had only full duty work for me, even tho I was unable to do
my job anymore, so I was forced to quit. I was unhappy so I
consulted an attorney and he sent me to se a specialist, and
the specialist thinks I have torn ligaments and cartilage in
    the knee.

Both times I had seen the workers comp doc, I was talked
down to and insulted a total of three times. He only checked
the range of motion in the knee, "I am only concerned about
the joint." He replied and the only therapy in the knee he
offered was electrodes, and a sport balm rubbed on the knee
    itself.

Now I have some concerns, the same day I got hurt I went to
the hospital myself, and all they said was I had a
contusion, and abrasions. But after the ordered return to
work that same evening after work comp doc saw me, I think
    it worsened the injury.

    1. Can I go sue the hospital, work comp doc, and employer
for my worsened knee injury, for misdiagnosed?
    2. Work Comp doc for malpractice and ignoring my injury?
    3. My job, for forcing me to resign, after no offer of light
duty work, because work doc said I MUST be on full duty?

Any and all advice will be appreciated in this matter.
