Post: Wrongful Termination?

Posted by Tina on 7/06/06
Back in Novemember, my husband injured his shoulder. The
doctor's believed it was a possible rotator cuff tear, but
he was unable to get a MRI to determine it. He had to
hire a lawyer to file a workman's comp claim, since the
company he worked for at the time even refused to have the
manager on duty at the time fill out an injury report.
The first hearing was missed due to a death within the
company, the second was dismissed all together due to an
issue that his lawyer had missed out on. After the issue
was dismissed, my husband's doctor released him back to
work. My husband had his doctor fax over the release to
his office, then called to find out where he would be
going. We waited the whole weekend for a call from his
job, but nothing. Then on Monday, the work coordinator
called to say he had been laid off.
My husband worked for a union, and at the time the company
not only had people working overtime, but also had
travelers from another union still working for the
company. Does this sound like a case or wrongful
termination?
