If you reside in CA and you feel that your were fired due to
filing a workers compensation claim you can file an additional
action against your employer at the WCAB. Specifically it is
called a 132A Claim and you do it through a separate petition
that you file with the WCAB. If you win and the judge believes
that you were fired for making a workers compensation claim
you will get additional money which can be substantial that
your employer will be required to pay out of their pocket. Get
a copy of your personnel file before you file this type of claim.
You may also have rights to file a discrimination civil action
if the discrimination was centered on your physical condition.
