LEGAL COUNSEL - Abroad (Abu Dhabu)

We are recruiting a lawyer for the Health Authority in Abu Dhabi, United Arab Emirates

Enforcement Lawyers & Advisors

Reports to: Head of Enforcement

Enforcement lawyers will

• Ensure that GAHS appropriately identifies, mitigates and adopts effective “best practice” strategies with regard to the legal, commercial and financial risk in all contracts and other legal documents in relation to outsourcing & privatisation

• Help the Regulatory Authority define and prioritise essential legal gaps in healthcare legislation to be filled in cooperation with other involved government entities

• Define procedures and sanctions for non-compliance and fraudulent behaviour against laws and regulations

• Issue warnings and communicate decisions on penalties, suspensions and revoking licenses to providers and health professionals

• Develop and review inspection reports and overview activities of inspection team

• Investigates complaints against providers and health professionals

• External legal consultants advising GAHS on privatisation and outsourcing contracts

• Monitoring performance of external partners of GAHS against contractual obligations

• Legal assistant(s) responsible for:

• Registering and issuing warnings, penalties, suspensions, and for revoking licenses

• File legal cases against providers/professionals/other organisations

• Activities of Inspection Team and enforcement of legal requirements

Key Tasks:

• Ensure that GAHS appropriately identifies, mitigates and adopts effective “best practice” strategies with regard to the legal, commercial and financial risk in all contracts and other legal documents in relation to outsourcing & privatisation

• Identify the specialist legal advice required by GAHS and to source and manage the provision of such advice in an integrated, timely and cost effective manner

• Liaison with stakeholders as required

• Define procedures and sanctions for non-compliance and fraudulent behaviour against laws and regulations

• Issue and register warnings and communicate decisions on penalties, suspensions and revoking licenses to providers and health professionals

• Take legal actions by filing legal cases against providers, health professionals and other vendors

• Develop and review inspection reports and overview activities of inspection team

• Investigate complaints against providers and professionals

Performance indicators:

• Accuracy and quality of performance management of contracted external partners

• Level of successfully enforced compliance with laws and regulations (e.g., number of paid fines and enforced suspensions)

• Number of complaints against legitimacy and consistency of enforcement

Essential Competences:

• Ability to oversee and quality control large volume of legal documents and provide assistance on multiple aspects of legal affairs

• Strong process and project management skills

• Judgement and decisiveness

• Very strong communication and analytical skills

• Attention to detail in verbal communication (esp. written documents)

• Extra-organisational awareness (public, government, press, etc.)

• Fluency in either Arabic or English; proficiency in the other language is an advantage

Essential Knowledge:

• Law degree with practical experience in management of health care related legal cases

• Valid licence to practice law in UAE and underwrite contracts is an advantage

• Experience in legal affairs in Abu Dhabi or Dubai, with a strong track record of managing legal aspects of major transactions, or

• International experience with health care related purchasing and commissioning

• Experience in drafting RfPs

• Experience in international legal systems in regard to setting and enforcement of minimum requirements for healthcare providers

• International experience in medical negligence and malpractice law is a distinctive advantage
