It doesn't bother me one bit that guards were yelling at you
for your 3rd shoplifting offense. The yelling might be
relevant to the context in which you made statements, if in
fact you did. But no one -- I mean no one -- will care
about your perception of being mistreated. A lot worse will
happen to you if you get convicted a 3rd time.
The fact that the items were not on your possession or had
they left the store is important. Technically, I am not
sure you stole a damn thing. You were planning to, but I'm
not sure you did it yet. You really need to check with a
local criminal lawyer to figure out the interplay of those
facts with your state's law and with any confession you
might have made to the guards. Do it sooner rather than
later.
In short, you might have a defense and jail time is likely.
That means you need a lawyer. Don't talk to the police and
don't try to represent yourself on this one.
