    Post: Due on-to-you Process

Posted by Gary M on 3/01/04

I'm 4 years into a cigarette tax protest in New Jersey and
haven't [yet] received any fair, equal or due process. I
will be sending a petition for certification to the New
Jersey Supreme Court next week. I'm assuming the appeals
court wouldn't have done what they did if they were not
pretty sure the Supreme Court would go along...So I'm not
very optimistic. I figure my next step is federal court. I
would like to claim in my federal court filing that the New
Jersey Judiciary system has violated my constitutional
rights. The problem is the Section 1983 statute has some
language that would appear to exempt "judicial officers"
from claims of criminal violations of constitutional law.
Is that a correct interpretation? Are there any other
federal statutes that would enable me to sue the New Jersey
    courts system for damages?
