I was question by a detective about a check that was
written he said in Nov. 2006 but he said he did not know
who it was on and he said that my mother's name was on the
check but they saw my social security number. He asked me
my social security number and date of birth and he said
that there was a warranty for my arrest and I asked him for
what because I did not know anything about a check in Nov.
2006 and I told him that I was on probation for checks and
I did not have a checking account but my mother had an
account and I was on the account. He asked me did I have
the authority to write on the account and I said well, my
name is on the account but it is her account. He said that
he was going to have to take me to jail. He never read me
my miranda rights. He called another officer to pick me up
and he never read me my miranda rights. I got a bail bond
person and was release but I have a court date. I want to
know if I can request the case be thrown out when I go to
court due to violation of my miranda rights.
