The reason I ask these questions is, a group of dealers in
Las Vegas are attempting to appeal a decision by a Nevada
judge who ruled that Steve Wynn, a casino owner, could take
his dealer's tips and share them with supervisors who watch
over the games. While state laws expalin that it is unlawful
for an employer to take all or any part of the tips or
gratuities bestowed upon his employees, Nevada's current
opinion seems to be that Mr. Wynn is not taking the tips
when he distributes them to workers of his choosing and
against the wishes of the dealers who actually where
presented tips.
The dealers would like to appeal this case to the US Supreme
Court however they have been informed that fedral laws have
no jurisdiction in this case. So while the DOL has a fact
sheet which states that the "law" forbids any arrangement
between the employer and the tipped employee whereby any
part of the tip received becomes the property of the
employer, the dealers are being told that there are no
federal laws which are relevent to this case and that they
cannot pursue their case through the federal court system.
Any help on this issue would be appreciated.
