Post: bonus payout issue

Posted by arjay on 9/18/08
I live in NJ but work for a firm based in MA. At this firm, employees are allowed to participate in a productivity bonus program which is all spelled out in the employee handbook. Each month, an employee can earn 1pct of his/her annual gross pay if he/she satisfies productivity goals. No issue there. However.... the *payout* of these bonuses occurs one quarter *in arrears* as long as the employee is on payroll. Example... the bonus earned for 2nd quarter months of Apr-May-Jun would not be paid out until *mid-October*. With this kind of setup, the employee will *never* collect the bonus for the last quarter he/she was employed even though it was earned. Furthermore, chances are great that he/she wouldn't get the payout for the next-to-last quarter either. This cannot be in accordance with compensation law... Can it??
