Post: Chat conversations to be used against me in court

Posted by Lei on 12/17/09
I signed a confidentiality+employment agreement with my
former employer 6 months ago.
I recently got fired due to the fact that my employer has
accessed my personal skype account to view history files
which contained a conversation of myself and another
outsourced employee about starting a business.
After my termination, I had claimed my vacation fee and one
week's notice, my former employer got furious and threatened
to sue me should I pursue to claim what is due to me.
He says he has copies of my chat history and will use that
in court.
My question is, will it be valid ? he could've just as well
written these conversations down himself, or it could just
as well be somebody else who has had those conversations.
The contract stipulates this part:
********
2. I agree that I shall not during, or at any time after the
termination of my employment with the Company, use for
myself or others, or disclose or divulge to others including
future employees, any trade secrets, confidential
information, or any other proprietary data of the Company in
violation of this agreement.

Can chat conversations be used against me in the court of
law ? ( Canadian )
Thank you in advance for your guidance
