My ex-wife and I signed a marital separation agreement back in June. She agreed to take full responsibility for a home equity that is in both of our names.She has been 30- 60 days late since the commencement of the agreement. We do not have a specific clause for her deferred payments.As she is not in default, in a court could the damage to my credit be considered as damages. My lawyer feels that the most they will do is tell(or put it in an order)requiring her to pay the home equity on time. I would like to be released from the note.Does anyone have any insight on this.
