    Post: Trustee Problem; Living Trust

    I am a beneficiary of a living trust in MN. There are
    three families of beneficiaries. The trustees (also
    beneficiaries) allowed two of the families to distribute
    the household personal property among themselves which
    included the trustees. The trustees failed to notify our
    family of this distribution. They claimed that they
    thought we knew that our family was not included in that
    part of the estate distribution. I received a copy of the
    trust today and there is nothing that states the special
    distribution instructions. It does allow the trustees
    sole discretion in the tangible property distribution
    though. The trustees claim they had verbal instructions
    from the settlor to make this distribution. There is a
    pour-over will to place the assets into the trust.
    Shouldn't this be an impartial distibution and would
    verbal instructions be valid? Should we petition to the
    court to determine if the discretionary distribution was
    proper?
