Post: Can I file abandonment/keep daughter away from ex

Posted by Molly Coddle on 1/03/11

I divorced my ex going on 5 years ago. He hasn't had any
physical contact with my daugter in almost 4 years. He quit
sending child support (which by the way was not sent
through the state, just a direct transfer from his bank
account to mine) on my first of this year. He also dropped
her from his health insurance and moved away from the state
he resided in which is not the same as where I am. I am in
Colorado. He called yesterday and said he's coming here on
Wednesday and would like to see her. 1st: Am I in any way
legally bound to let him see her? (There was not anything
past our divorce decree filed with the court, the language
only goes so far to say that we will enjoy "joint decision
    making".)
2nd: Can I file for abandonment and if so, can my husband,
(commonlaw) adopt her without it being a problem? Any
    advice would help. Thanks.
