Post: H1b employer not paying

    Hello

    I was employed by a company which sponsored my H1b, they
    were late on payments and did not pay me at all between Feb
    2009 to Nov 2009 (I left at end of Nov 2009). I have now
    found another employment, and I cannot start at the new
    company, I am doing a new H1b, since it was out of status
    for this whole time. I will be leaving the US to reset my
    H1b, the process is already started and I have another week
    until I get an answer back, then I will need to leave the
    country to renew the H1b.

    Now comes my question, when I return or even before them,
    is there a way to force the old company to pay my salary?
    Or are they completely free from consequences?

    My current immigration lawyer cannot answer this question
    because he was the lawyer to both cases, the old company
    and the new. Conflict of interest I guess.

    Please let me know as soon as possible.
