    Dear Juanita,

    Each year, millions of visitors, foreign students, and
    immigrants come to the United States. A visitor may enter on
    a legal temporary basis--that is, with an authorized period
    of admission that expires on a specific date--either with a
    temporary visa (generally for tourism, business, or work)
    that the Department of State issues or, in some cases, as a
    tourist or business visitor who is allowed to enter without
    a visa. The latter category includes Canadians and qualified
    visitors from 27 countries who enter under the Visa Waiver.

    France Citizen are participating in the visa waiver which
    mean that you can travel without visa in and out from the
    U.S. However, because you have overstayed your visa the
    immigration will deport you back to France.

    Anyway, if you have a Fiancee (US Citizen) and you’re
    planning to get marry you can have the baby here in US
    (he/she automatically become a U.S. Citizen) then you can
    return back to France (voluntary departure). Then your
    Fiancee can file for (K-1) visa is an non-immigrant visa
    allowing you to enter the United States for the purpose of
    marriage or you can marry in France then applied for K-3
    visa. The K-1 visa is for you to return to US and get marry.
    The marriage must take place within 90 days of entering the
    United States. The other option to get marry here in US and
    then file for visa.
    If the marriage does not take place within 90 days (if you
    re-enter on K-1) or your fiancee marries someone other than
    you (the U.S. citizen filing USCIS Form I-129F - Petition
    for Alien Fiancee, then you will be required to leave the
    United States. Until the marriage takes place, then you will
    considered a nonimmigrant. A nonimmigrant is a foreign
    national seeking to temporarily enter the United States for
    a specific purpose. However, it is important to seek help
    from Immigration Attorney to better service your interest.
