Dear Counsel.Net Friend, The general rule is that "Every act of man that causes damage to another obliges himself by whose fault it happens to repair it." LA Civil Code art. 2315. Not the same rule everywhere, but generally the same principle applies everywhere. Can you sue? Yes. Will you win? It all depends. If you don't file a suit, you ain't got a chance. (Enallage used.) If you sue, you might win a judgment, or a settlement. A bad settlement is better than a good law suit. Go for it! You will need legal counsel, however. There is more to it all than this, but this is something to think about and something that is relevant to your questions. Good luck!
