I think it's a federal law stated that anyone should ask anyone permission before they can record conversation over the phone, otherwise court issues a warranty to record your conversation without your knowledge. I wouldn’t worry about it since I think the law will be on your side that the person is out of cmoplying with federal law or so for record your conversation, if in record stated that the person never asked your permission for it. It should be useless in court since it violate your right at the first place if they record your conversation over the PHONE without your permission. Report that to federal law enforcement, not to local or state police, unless local and state law recognizes the federal law to their level for crimial action so if they have evidence then they might take action.
