Post: Defamation with malicious intent

In a legal "Certification' to the courts for a child custody case, the father stsed that I had "Prior DWI"S" , and drove while drunk with his son in the car. I am his mothers boyfriend, and have been the childs "POP POP" since the day he was born. The suit was against his mother who had custody of the child, because he was abandoned at our home by his mother. When he was presented with a certified abstract of my driving record in court, showing I never had a DWI, and his mother testified that I never drove when I had more then 1 drink ( she did, and does not drink at all), let alone drunk. He then told the judge the reason he stated that was "because he thought his mother told him that I had prior DWI's, another lie. Because this statement was made maliciously, and for no other reason, then to show that I was "unfit" to watch his son, and to cast asspersions on my name, do I have a case for "defamation" even though he changed his story in court and said "He Thought"? In a previous certification made to the courts anything that he was "told" was stated that "he was told that".
