I had some questions about my civil rights regarding a HIPPA violation that has occured at my place of employment. I work for a Nursing Home in Virginia as a CNA. In March 05 I had an inncident at work, and had to have my labs drawn. I found out that I was HIV positive. Four people were made aware of the situation. The Director of Nursing, Infection Control Nurse, the PHD that ordered the lab work, and the Administrator, and my personal PHD. No one else was made aware of my situation. My family doesn't even know. Finding out that I was positive for HIV was hard enough. Now, I have heard reports from co-workers that I am dying of AIDS. I have addressed this issue to the Director of Nursing on several occassions. I told her the stress from constantly being asked if I was "sick" or "feeling bad" or if I am seeing an Infectious disease specialist has caused my mental anxiety and physical weight loss. Do I have reasonable grounds for a suite against my employer? If so, what do I need to do? Also, my employeer has told people I have "mono" to cover up any truth. Now, I don't know much about the law, but I do know that making up false reports about other people's health is wrong. I feel like I have good cause to file a lawsuit against my employeer. What are the steps I need to take? Thanks, - Matthew
