    Post: Repayment of "ward of state" costs deductable?

    I am helping my father in law do his income taxes. Back in
    1973 he and my mothern in law had a son born prematurely
    that had serious brain damage and was made a "ward of the
    state" and placed in a state (CT) run nursing home until he
    passed away in 1984. Over time the state and nursing home
    facilities have all come after my father in law for
    repayment. The state took his income tax returns for years
    and now a collection agency is collecting payments from
    him. Are these payments able to be itemized as "dependant
    care expenses" even though his son has been deceased?
