hi i am new to this board i hope i am allowed to post
here.anyway aprox 8 years ago i had feel off a horse and
broke the tip of my clavical this went on to be an
inpingment.aprox 1 and a half years ago i fell on
outstreached hands due to no lighting and a tree branch.
the day after my fall i went to the hospital er. i
complained of my neck and my shoulder back and actully
whole body in pain.i had an ebt done and the defendents
attorney showed me the er report and it said it was the
oppiset shoulder and i know i never said it was the
oppisit shoulder the took xrays of my neck and it showed i
had a curveture in my neck. they never took ex rays of
anything eles.they kept me out of work till a doc realesed
me back.now heres where it gets even more fustrating to
me.i saw an ortho like the hospital told me to and the doc
examined me but he exaimend me for my old injury he never
stated that i fell or my neck pain or anything. anyway i
have a witness and a signed document that i did state i
fell to the doc is that a good peice of evidence? well i
keep seeing the doc and telling hime how i fell off the
horse and how i fell in a driveway. the doc then says that
i need to have surgery to remove the impingement in my
shoulder that it was causing my neck and back pain. now
how he diagnosed this was by using old mris and old x
rays. he never got new ones or did x rays or mris.so i had
my surgery and after my surgery the doc was fired the day
after for medical misconduct by using alchol.to make a
long story short i went to my follups and the new doc took
an x ray and found a new prominace of bony fragments with
an ac joint seperation.now when i fell off the horse i
never had an ac joint seperation but had an partial ac
deranagement. as of today i see pain management docs and
in the er once a month due to the really cold weather.i
still have pain in my neck and in my back and my shoulder
i have seen 3 ortho and none of them say its a good idea
to have the surgery to fix the ac joint that i have a
50/50 chance of full recovery.so i choose to be on pain
pills for the rest of my life with a combo of muscle
relaxers and valiums.i feel i am wasting my time on htis
lawsuit. the reason why i say that is cause i am on
probation and for 5 years and my attorney says it dosent
look good for my case cause a jury is not sympathatic to
criminals. the other thing was no one saw me fall what do
i do what do you guys think plz help with some good advice
