    Post: Workmans Comp dropped while still injured

    My husband was involved in an accident while unloading
    freight at a Dollar General. This was part of his
    responsibility as a truck driver for this route. The
    freight had shifted and hit him in the head and knocked
    him out of the truck onto the concret parking lot. He
    woke up later in the ER. When he was released, his
    compnay chewed him out for not finishing his route and
    then refused to escort him home after the Drs said that he
    could not drive and had to be waken up every hour when he
    slept. Though, they were able to send a driver to get the
    remainder of his load. He had to drive from IL to SW MO
    on his own.

    He was on WC for about 5 months and then they dropped him
    without reason. We then found out through our attorney
    that it was because his employer said they offered him a
    desk job and he never responded. We were never notified
    of this for one, two, he would have to move over 300 miles
    away from his family and 3 kids and live there in a
    hotel. This was all 3 years ago.

    We have had an attorney for the whole 3 years and have
    barely seen any progression in our case. My husband has
    permanent damage in his brain because he suffered from a
    concussion and now can no longer drive a truck.

    Now, our attorney is changing careers and is refering us
    to another firm for our WC case. Now I amafraid our
    statue of limitations is up since it has been so long.
    The company is located in Omaha, NE and we are in
    Anderson, MO.

    Please let me know what you think we should do. No one in
    our area will look at it since this claim crosses the
    state line.
