    Jason, workers' compensation is different in different states.
    I assume that you gave notice to your employer at the time of
    the injury and that you have preserved the statute of
    limitations by filing a Petition with the appropriate state
    agency. Workers' compensation usually is some percentage of
    your pre-injury earnings. You generally do not have a right
    to sue for pain and suffering but in some states there are
    exceptions for such things as gross negligence.
