Teresa,
If the two of you were in agreement as to what you were
paying for (and hopefully you have a signed contract stating
such), then the contractor is in breach. Basically the
contractor failed to perform a contract in accordance with
its terms - It does not matter if the failure was purposeful
or inadvertent, it is a breach.
Do not pay what you owe! Instead, send contractor a
certified/return receipt requested letter outlining your
original agreement, the deviations from that agreement, and
what you would like done. Give him/her ample time to reply
(about 10-15 days) from receipt of the letter and state what
you next steps will be (file suit) should he fail to reply.
State all of the facts and be as detailed as you can so that
there your requests and/or intentions are clear and precise.
If contractor does not reply you can either file suit in
small claims court (depending on the amount of the claim) or
in circuit court within your state that has jurisdiction.
