Dear Frank,
What you have here is a contractual matter. A lot depends on what the contract you signed said. If the car has been registered in your name, you do not even have to bring it back; for it is yours. YOu may owe on it; but so long as you make your payments on time, the seller has no legal recourse against you. Next, if it is not in your name, you do have an obligation to return it, for the sale was never consummated; but you are entitled to a refund of your money, unless the contract provided for this very situation and the contract says that the seller can keep all or a portion of your money to compensate him (or it) for your use of the car while the financing was being applied for. Yours is not an easy question to answer without knowing all of the details surrounding your purchase of the vehicle and without being able to see a copy of the papers that you signed. Best of luck to you! Sincerely, Hardy Parkerson, Atty. Lake Charles, LA On 6/24/04, Frank wrote: > Bought a used vehicle appoximately two months ago. Made my > first car payment on 6/16/04 on time.
