I don't think you have a great defense. The state can
probably prove to a jury beyond a reasonable doubt that you
drove the vehicle to that location. However, if you have some
story about how the vehicle arrived there, and how you
intended to get transported somewhere else without driving
then you might have a defense. Just like in a DUI case, the
fact that the keys were not in the ignition, matter here. You
also have a possible entrapment defense, but you would have to
prove that you had no proclivity to drive the vehicle had they
not asked you to.
