    I understand from your post that you are trying to file a
    Motion or application or petition to expunge pursuant to Penal
    Code section 1203.4.

    The petition (or application or motion) is filed with the
    court. The court will set a hearing date. Often, the motion
    can be granted without a hearing.

    There may be a filing fee. If you qualify for a fee waiver,
    you will have to submit your Application for Waiver of Court
    Costs at the same time you file your petition for expungement.

    However, you will need to "serve" it on the District Attorney
    before you file it with the court. The court must know that
    all parties have been served. The District Attorney has the
    right to oppoose your petition (but it seldom opposes
    misdeamanor expungement petitions).
