well, now you've got something...
according to federal OSHA requirements, employers are required to
provide restroom facilities. so, a failure to do so can be a
workplace safety violation.
"OSHA's sanitation standard for general industry, 29 CFR 1910.141
(c)(l)(i), requires employers to provide their employees with
toilet facilities...." see Standard Interpretations 04/06/1998 -
Interpretation of 29 CFR 1910.141(c)(1)(i): Toilet Facilities at
http://www.osha.gov/pls/oshaweb/owadisp.show_document?
p_id=22932&p_table=INTERPRETATIONS online.
It also says: "The quoted provision of the standard is followed
immediately by a paragraph stating that the toilet provision does
not apply to mobile work crews or to locations that are normally
unattended, 'provided the employees working at these locations
have transportation immediately available to nearby toilet
facilities which meet the other requirements' of the
standard ...."
so, file a complaint with OSHA, or your state workplace safety
agency, or find a lawyer and sue.
