Legal Guardianship and custody are not the same thing. Where there is a legal guardianship ordered by a court, the parent[s] rights are suspended. Generally: Grandparents with temporary custody can not authorize medical care; however, legal guardians can. Of course, in an genuine emergency, the hospital can still treat the child.
