Dear Nabila, You can file or obtain a K-3 visa for non-immigrant visa. You should receive it within a few months after filing. Your spouse should use the K-3 visa to start the process outside of the U.S., then travel to the U.S. to complete the immigration process. However, the K-3 application should be made in the country where the marriage took place. If your marriage took place in the U.S., your spouse must apply through the U.S. Embassy in the country of his or her residence (Please notice I don’t know if they have change to new form but sometime they still used an old form called I-129F “petition for alien fiancé rather than spouse make sure to double check with the U.S. Embassy). Or contact a immigration lawyer to help you with the process.
