Dear Heidi, I am sorry no one has responded to your post in all the time that has passed since you posted it last month. I assume by now you have found your answer some other way than on this board. However, if not, feel free to call me at (337) 478-6126, and I will discuss it with you free of charge. I am not licensed to practice in Florida, however; so, naturally, I will encourage you to discuss it also with a Florida lawyer. Be all that as it may, it looks as if you might have a claim against him for damages, depending on a lot fo things. If Florida has a so-called "no pay, no play" insurance rule, you probably won't have. If not, possibly so, depending on the time limitation for filing a suit in Florida. It is only one year in Louisiana, or a short time longer if you ar the first one to get sued. In other words, in Louisiana, if the other person sues you first, this gives you a little more time than is ordinarily allowed for filing suit in which to counter-sue him.
