    Dear Joe,

    This is a board for real law students writing about real law
    student problems. You start out by stating my "former
    attorney screwed up". Then you start rambling about code
    references from who knows what state codes, and throwing
    around legal terms like ex Parte, motion, but you never say
    what the current status is.

    But it really doesn't matter.

    Any law student who tries to answer this beyond sending you
    on your way is a fool. And since you say you are not a law
    student, you wouldn't know that the law varies by
    jurisdiction, by whether or not this suit was being done in
    federal or state court, etc. You haven't said what the
    jurisdiction was, whether this was in state or federal
    court, etc. Most law students learn little more than the
    federal rules of Civil Procedure, which are loosely adopted
    in many but not all jurisdictions.

    If you go back and look at your own posting, you'd realize
    that even your long post is lacks anything bordering on
    being coherent. Hence the "huh?".

    Since "you don't know what to write", I would strongly
    recommend you find another attorney in the proper
    jurisdiction and go from here. You may be able to revive
    your case and/or bring some action against the attorney for
    malpractice. A clerk can give you the proper papers, but
    they themselves are not there to help pro se (the proper
    term) plaintiffs set up complaints.
