Two issues here. Crime and tort.

Crime: Whether a crime was committed will depend on the laws
in your jurisdiction. The way you find out if there is a crime
is to go to your local police station and say you want to file
a report. If there was a crime, they will take the report. If
there was no crime, they won't.

Tort: Again, result may be jurisdictional. Here, the answer
will come from a trial attorney, who will either take your case
on contingency or not. Depending on whether the plaintiff was
an unemployed street-person or a wall street rocket scientist,
etc., damages (which include lost wages) will vary. If a good
trial lawyer can establish a tort case, then damages could
potentially be huge for a brain injury case.

Out of curiousity, where do you you live? Maybe someone here
knows a good trial lawyer for you to consult.
