Crime: Trespassing?! If the rider did not have permission
to 'ride' on the property, there is no case against the land
owner.

Tort: Again, if rider was trespassing, there is none.

Only when the OP responds to DHM's question regarding permission,
can a 'firm' answer be given. OP has yet to respond.
