    I assume this case is being handled on a contingency basis
    meaning your attorney gets paid only if there is a monetary
    judgment or settlement made by someone. It is unlikely that
    an attorney would let a "good" contingency case slip away.
    If the other driver has no insurance and your insurance
    doesn't have uninsured motorist coverage there may be no one
    to pay a judgment even if you win.

    You might consider paying an attorney by the hour to look
    into your case and explain to you your chances for
    recovering a settlement.

    By the way, this is not a legal advice forum. It is for law
    students to discuss school related issues. Client counseling
    is a topic in law school but should be undertaken in a moot
    forum. Some student contributors do respond to hypothetical

    counseling but it should not be taken as real legal advice.
