Post: discrimination

There is documentation of a department manager who is not
performing duties but the company refuses to fire or
reassign her due to fear she will sue. She is 60yrs old,
woman, and black.
We are in a right to work state so tech. they don't even
have to have a reason.
I am having to leave the department I enjoy because she
has made the working environment unbearable. Besides Im
tired of doing all her work. She does get paid more and is
actually the manager. I am only a worker in the department.
This is not the first location she has worked at or had
these issues with for the same company.
What, if any, would be my recourses so that I could stay
where I want and they would have to "deal" with her?
