    Unless he/she wants to be sued, they will proceed prior to
    the SOL running. Many times attorneys intentionally refrain
    from responding in hopes that they are fired which gives them
    an out of a case that is not as attractive as it once
    appeared. If the SOL runs without proper action on your
    attorney's part, consult with an attorney who specializes in
    attorney malpractice. Keep your contract handy as well as
    any correspondence.
