    What do you mean by 'trying to server papers'? If he has
    your address then that's where they should be delivered. Has
    he sent them to your address? Have you refused to accept
    delivery?

    If you refuse to be served then yes, he can proceed without
    you. If he hasn't sent the papers to you then he can attempt
    to proceed but it won't get him very far. HE needs proof
    that he attempted to serve you and without that proof...
