The reason I had asked the "fault" question is that I too had a son hit while crossing a road.He just had some very minor injuries. It was deemed my son's fault and therefore we had no suit against the driver. The other driver's insurance did make a good faith settlement to my son for a very small amount. And my car insurance paid for his hospital bills, so we were not out anything monetarily. I suggest that you contact a personal injury attorney ASAP. There should be a reasonable payment put in a trust for your son for this accident. I couldn't begin to tell you what you should ask for, but I will tell you if your attorney asks for too much you will be spending the next two years in court before it's settled. I saw a settlement for a man who lost his leg in an accident and he received $500k before attorney fees and costs. After all those he had about $300k left over and he and his wife blew it all within one year. They are now divorced. The injuries to your son do not appear to be permanent and he appears to have fully recovered. There is a marked difference in these two cases I know, but that just shows you what a permanent injury could receive. I'm guessing your settlement could be in the low 5 figures, but again, your attorney would know best for your particular case.
