That is absolutely not true. He can not file for custody because he has no standing until/when he ever legally establishes his paternal rights to the children. As I said: Since they were never married AND if he has never legally established his paternal rights to the children under the laws of his state: They are her children and she can take her children wherever she wants, whenever she wants and he has NO SAY SO whatsoever about it. If he wants a say so, then he needs a court order saying he's daddy. Until then, he doesn't have any children to seek custody of.
