Re: construction Arbitration Services
Posted by Joe Keller on 5/12/08

We just received a letter informing us we lost our abitration case against the seller of the
home we bought in December. To sum things up we had to replace the main sewer line of
our home after realizing a major plumbing problem the second night we were in the house.
The arbitrator, Joanne Lewellyn, said the seller wasn't liable because the first plumber we had
over could've damaged our sewer line. This is laughable since we wouldn't have needed a
plumber over if our sewer line wasn't cracked and damaged. He figured it out with a camera
and attempted, unsuccessfully to unclog the line. He then determined that the whole line had
to be repaired and we had a second plumber do the work. The seller didn't show up to the
hearing sending his daughter instead. While I had my plumber and real estate agent there as
witnesses. Our plumber, who wasn't being paid for being there, told this idiot arbitrator that
the house was unlivable when we moved in because of the plumbing problem. He said it was
a problem that occured well before we moved in. This CAS is full of crooks. So, now I am out
thousands of dollars plus the amount take the case to arbitration. I wish I would'v come acros
this chatboard before this process started, then I would've known how awful CAS is.
