Re: Unpublished decisions
Posted by CS on 9/07/07

I also support the Arbitration Fairness Act of 2007. Nothing big business says in favor
of mandatory arbitration in consumer contracts holds water. This legislation would make
mandatory pre dispute arbitration clauses unenforceable. People could still choose
arbitration AFTER a dispute arose if they wanted to, though I don't know why any
informed consumer would. Big business benefits from keeping cases private and biased in
its favor, that is why they want to keep mandaory arbitration clauses. There are
already some state laws that are more fair, concerning when such clauses are
enforceable, but big business gets the cases moved to federal court. Also courts are
deciding in favor of arbitration, even in cases where it's clearly an unfair contract
that shouldn't be enforceable. Big business lobbying plus business friendly judges have
taken away any hope of justice for millions of consumers. This legislation would help
level the playing field again. Businesses who are doing nothing wrong have nothing to
    fear.
